Summary
The regulation of fertilizers and biostimulants in Romania is now superseeded by the European Union (EU) legislation, of which Romania is a Member State.
In principle, the only alternative route for placing a biostimulant or fertiliser product on the Romanian market under EU law would be Mutual Recognition pursuant to Regulation (EU) 2019/515, based on an authorisation granted in another Member State. This pathway is, in theory, reflected in Government Emergency Ordinance No 121/2022, Chapter IV – Legal regime for fertilising products tested and authorised in the European Union. However, in practice, Mutual Recognition is currently not applicable in Romania. Moreover, GEO No 121/2022 conditions the acceptance of such products on compliance with Annexes I and II of Regulation (EU) 2019/1009, which effectively imposes additional requirements and constitutes a de facto restriction on the Mutual Recognition principle as originally intended under EU law. We are waiting for the situation to change and will update this page as soon as registrations under national law or mutual recognitions are again possible.
