Summary
- 21 October 2026 -
Chad has no biostimulant category, and no Chadian or regional text in force uses the word. Products are classified by their claims. The decisive text is Décret n° 010/PR/MA/99 of 7 January 1999, which implements Loi n° 14/PR/95 of 13 July 1995 on plant protection.
Article 1 of the décret states that the term "comprend les agents biologiques, les régulateurs de croissance, les correcteurs de carences (nutrient deficiency corrector)“. The law's own definition also covers growth regulators. A biostimulant that claims growth regulation, corrects deficiencies or contains a microbial agent must therefore be assumed to be a pesticide.
A product presented only as a nutrient or soil input falls instead under the general input regime of the Loi d'Orientation Agro-Sylvo-Pastorale et Halieutique (Ordonnance n° 043/PR/2018, "LOAH"), which defines an intrant as "tout élément entrant dans la production Agricole" (Art. 1) but sets no product registration. Chad has no fertilizer registration law.
On the non-pesticide pathway there is no product registration, but there is a company licence. Article 82 of the LOAH reserves the production, import, export, distribution and sale of inputs to professionals holding an agrément from the competent services "conformément à la réglementation en vigueur".
Article 13 of Arrêté n° 009/PCMT/PMT/MDA/DGM/2022 of 5 January 2022 repeats this. Inputs are controlled at the customs border and on domestic markets (LOAH Art. 84; Arrêté Art. 14). The implementing text that sets the conditions and fees for this agrément has not been found. Article 169 of the LOAH also commits the State to set up a pre-marketing homologation system for chemical products based on risk assessment. No implementing text has been found, but it signals a future registration requirement.
Three provisions determine whether a biostimulant can be registered at all.
First, Annex 2 Part 7 requires a reference sample of the active substance, which presupposes a defined active ingredient. This is the practical obstacle for seaweed extracts, humic complexes, protein hydrolysates and microbial consortia. Second, Annex 2 Part 8 asks for the registration certificate from the country of origin, and a product sold in the EU as a fertilising product will not hold a pesticide registration, so the omission must be justified.
Status : For fertilisers and biostimulants, the position is confirmed against the full text of the LOAH (Ordonnance 043/PR/2018) and Arrêté 009/2022, which govern agricultural inputs. It is also confirmed against Décret 010/PR/MA/99 and Loi 14/PR/95 (FAOLEX scans of limited legibility), which decide when a biostimulant is treated as a pesticide.
The 1999 CILSS common regulation, the CSP guide of 2017 and the 2005 CEMAC regulation were reviewed only for biostimulants that fall within that definition. No text examined mentions biostimulants, and no fertiliser product registration text was found.
Five points remain provisional until confirmed in writing by the DPVC and the Ministry in charge of agriculture.
- The first is whether biostimulants are treated in practice as pesticides under Article 1 of the décret, as fertilisers or as general inputs, and whether microbial products are treated differently.
- The second is the implementing text, issuing service, dossier, fee and validity of the input agrément under LOAH Article 82, which applies to fertilisers and to biostimulants outside the pesticide definition.
- The third is whether any labelling, language or import requirements apply to fertilisers and such biostimulants, for which no text was found.
- The fourth is, for biostimulants on the pesticide pathway, whether Chad registers through the CSP, the CPAC or both, and at what fee.
- The fifth is whether a fertiliser or biostimulant text, the Code rural (LOAH Art. 221, due by 2023) or the homologation system of LOAH Article 169 has been adopted since 2018.
