Summary
French Guiana, as an outermost region of the European Union, is fully covered by EU law regarding fertilising products and plant biostimulants.
This means that EU regulations apply directly, just as they do in Metropolitan France, while national French implementing law also applies wherever EU law allows member states to adopt national measures.
The legislation governing the placement of fertilisers and plant biostimulants on the market is therefore either the European Fertiliser Regulation (EU) 2019/1009 or the French national fertiliser framework, set out in the Rural and Maritime Fishing Code (Code rural et de la pêche maritime), which regulates Fertilising Materials and Growing Media (MFSC — Matières Fertilisantes et Supports de Culture).
When a product is not harmonised under the EU system, it may still require an AMM (Autorisation de Mise sur le Marché) under French law to be placed on the French market, including in French Guiana.
However, if your product meets the definition of a fertiliser under the FPR and complies with all its requirements, no individual national registration or authorisation is needed, and the product can be marketed throughout all EU Member States, including French Guiana, with a CE mark.
Obtaining the CE mark requires conducting a conformity assessment in line with the European Fertiliser Regulation.
If you opt to follow the national route instead, you must comply with the provisions of the applicable national fertiliser legislation and/or relevant national standards.
