In Luxembourg, there are 2 ways of placing fertiliser products, including biostimulants, on the market;
either through application of the new Fertiliser Regulation 2019/1009 or through Mutual Recognition according to the EU Regulation 201/515.
It means there there is no national law on fertilisers (there actually is, but it is no longer applicable), that could serve as a basis to place your fertiliser product on the market, such as in Germany, where you can place your product on the market if it is compliant with the national German fertiliser law.
That possibility, as we understand, does no longer exist in Luxembourg. Either you comply with the European Fertilsier Regulation, or your story ends here.
The other way is Mutual Recognition.
This means that you can place your fertiliser product on the market in Luxembourg if you have a valid and legal position on the market in an other EU-Member State. We are currently clarifying detail-questions with the Luxembourg Government and will update these here as soon as we know more.
