        Biostimulant legislation in Romania

      • Summary

        The regulation of fertilizers and biostimulants in Romania is now superseeded by the European Union (EU) legislation, of which Romania is a Member State.

        No other national legislation is available for these products.

        The only other option to place a biostimulant or fertiliser product on the Romanian market is the Mutual Recognition according to Regulation (EU) 2019/515, from another MS, covered by the Government Emergency Ordinance No 121/20221 under Chapter IV – Legal regime for fertilizing products tested and authorized in the European Union (GEO no. 121/2022) and provided these products comply with Annex I and II of the European Fertiliser regulation (EU) 2019/1009, which, de facto, is a further restriction to the principle of Mutual Recognition as it was intended.

        In addition, fertiliser products or biostimulants made from sewage sludge must not be placed on the Romanian market through Mutual Recognition.

        Ordinance No 121/20221 provides for the documentation and information necessary to conduct this Mutual Recognition for products that are eligible under it.

        The competent authority for fertilizing products is responsible for applying the provisions of art. 5-8 and of art. 11 of Regulation (EU) 2019/515 is the Romanian MADR (Ministerul Agriculturii și Dezvoltării Rurale).

        Economic operators wanting to place a biostimulant or fertiliser on the Romanian market through Mutual Recognition are asked to contact MADR before doing so for a case-by-case assessment of the situation.

        The fees for MADR depend on what is requested:

        Evaluation of a MR application: 400 euros/product + 200 euros for the decision (approval or rejection)

        Evalution of a direct placing on the market: 600 euros/product
