        Biostimulant legislation in Slovakia

      • Summary

        In Slovakia, both EU regulations and national legislation apply to fertilisers and biostimulants.

        This means, EU regulation 2019/1009 applies to fertilisers and biostimulants that are compliant with this regulation and the slovak national legislation applies to those products that are not compliant with the European Fertiliser Regulation.

        Of course, Regulation (EU) 2019/1009 defining certain biostimulants (unfortunately, not all biostimulants are eligible under said framework, though it is often believed so - our experience tells a different story), harmonised CE-marking and so on for fertilisers and biostimulants also applies in Slovakia, which is a EU Member State.

        However, the national laws remain in place and they would be your route to go if you can't or don't want to go through the hoops of the EFR 2019/1009. The Slovak National Law Act No 136/2000 Coll. on Fertilisers is the basic law and it has been amended by Act No. 242/2022 Coll. to reflect the amendments brought by the applicaiton of the EFR in Slovakia.

        For instance, it provides for detailed rules on labelling, such as to clearly state composition, the certificate number (unless it's a CE-marked product), use instructions, safety instructions, and so on. Labelling requirements are set out in Act 136/2000 as amended by act 242/2022, as well as Decree n° 577/2005.

        Decree n° 577/2005 is indeed another important document, as it defines national fertiliser types, the mandatory and/or possible composition composition in line with these product types, packaging, analytical methods, thresholds for contaminants etc.
