Summary
Biostimulants are not regulated by a dedicated law in Thailand but fall under the Fertilizer Act as organic or biological fertilizers if they meet the relevant definitions. They must be registered with the DOA, and additional controls apply if they are imported or contain living organisms. The regulatory pathway depends on the product’s composition and claims.
Biostimulants do not exist as a category per se, but are primarily regulated under the Fertilizer Act B.E. 2518 (amended B.E. 2550) and overseen by the Department of Agriculture (DOA), provided they fit under that fertiliser law.
It also means that there is no separate, stand-alone law specifically for biostimulants. Instead, plant biostimulants are usually classified and handled as either organic fertilizers or biological fertilizers, depending on their composition and intended use.
If a biostimulant contains nutrients, microorganisms, or organic matter and is marketed for plant growth or soil improvement, it is likely to be regulated as a fertilizer (organic or biological) under the Fertilizer Act. If it makes pest-control claims, it may be regulated as a pesticide under separate legislation.
Products classified as fertilizers must be registered with the DOA (the Thai comptent authority) before manufacture, import, or sale. The registration process includes submitting a detailed dossier with product composition, intended use, manufacturing process, laboratory analyses (nutrient content, pathogens, heavy metals), and safety data.
If the product contains live microorganisms, plant material, or is being imported, it is also subject to the Plant Quarantine Act, which may require additional permits and phytosanitary checks.
Label claims must avoid references to pest or disease control unless the product is registered as a pesticide. Only claims related to plant growth or soil health are permitted for fertilizers.
Registration requires company credentials, product details, lab test results, manufacturing process documentation, and compliance with DOA guidelines.
