Summary
To sell a plant biostimulant in Zambia, you must treat it as a fertiliser under the Agriculture (Fertilisers and Feed) Act: ensure your manufacturing/processing plant is registered (or you import lawfully), and ensure the product is sold with the prescribed statement of analysis/label information (including extra disclosures if sold under a trade name/brand).
Definition of a “fertiliser” under the Zambian law: “"fertiliser" means any substance or compound of substances, which is intended or offered for sale, or sold, **for use in the improvement or maintenance of the growth of plants or of the productivity of the soil**; but does not include farmyard or stable manure; kraal manure, compost, wood ash, town refuse or night soil, when sold in its original conditions and under its name”.
First, you have to determine how your biostimulant will be classified under the Zambian law.
While there is no registration procedure for plant biostimulants, if you manufacture or process in Zambia, you have to register your plant or make sure you import lawfully. If you import the biostimulant: ensure import is permitted and compliant.
This means, when selling fertiliser, you must comply with the Act’s requirements on providing a prescribed statement of analysis, depending on how it is sold:
- Sold in bags/containers: you must furnish the purchaser a statement of the prescribed analysis in the prescribed form at delivery.
- Sold in bulk: you must furnish the purchaser a statement of the prescribed analysis of the bulk material at delivery.
- Sold under a trade name/brand: the prescribed analysis must appear legibly on the container/package/label.
If you provide the prescribed statement on sale, it operates as a warranty that the product will not vary beyond the prescribed limits of variation.
If the fertiliser contains bone or other substances derived from animal carcass, it must be sterilised and certified as prescribed; otherwise manufacture/sale is prohibited.
Testing for purposes of the Act must be done in an approved laboratory; testing in a non-approved laboratory for Act purposes is an offence.
