        Biostimulant legislation in Poland

        Placing fertilisers and biostimulants on the Polish market is a complex area.

        Of course, the European route via the European Fertiliser Regulation with its CE marking is an option, but there is also the national route, which is governed by national legislation, supplemented by European legislation, as stated in Act of 2020 on the announcement of the consolidated text on the act of fertilisers and fertilisation.

        The primary national legislation concerning fertilisers is the Act on Fertilisers and Fertilization from 2007. This act, along with its subsequent amendments, provides the framework for the production, import, marketing, and use of fertilizers within Poland. It defines different types of fertilizers, sets standards for their composition and labeling, and outlines the responsibilities of manufacturers, importers, distributors, and users. The Act also addresses issues such as fertilizer storage, application, and environmental protection related to fertilizer use.

        To apply for a direct authorisation (in case that is needed because the product can not be placed on the market under the applicable fertiliser legislation) a dossier needs to be complied and submitted to the competent authorities.

        The necessary data concerning physical, physicochemical, chemical, biological or agricultural tests are carried out taking into account § 3 of the regulation on the implementation of certain provisions of the act on fertilizers and fertilization on a product sample taken by an authorized sampler, e.g. from a regional chemical and agricultural station.

        The Ministry of Agriculture and Rural Development encourages you to set up accounts on the ePUAP platform to which correspondence regarding obtaining permits for marketing fertilizers and plant growth aids can be sent ( a so-called ePUAP box).

        Mutual Recognition is also a possibility to place a fertiliser product, including biostimulants, on the Polish market.

        In case the product is authorised/registered in another EU Member State (EU MS) (insert a link to the list of all current EU Member States) no notification with the authorities is required prior to placing the product on the market according to Art. 4 of Regulation (EU) 2019/515 (insert link to regulation).

        However, an inspection by the State Plant Health and Seed Inspection Service in accordance with Chapter 6 of the Fertilizers and Fertilization Act can happen at any time and operators need to be prepared for that. In the event of an inspection, a document confirming the registration of the product in another EU MS should be submitted, as well as a Mutual Recognition Declaration.

        Having said that, a product authorised for marketing in another EU Member State that is placed on the domestic Polish market should meet the requirements set out for domestic products in the Ordinance of the Minister of Agriculture and Rural Development of 18 June 2008 on the implementation of certain provisions of the Fertilisers and Fertilisation Act (Journal of Laws No. 119, item 765).

        Mind you, a product authorised for marketing in another EU Member State that is placed on the domestic Polish market should meet the requirements set out for domestic products in the Ordinance of the Minister of Agriculture and Rural Development of 18 June 2008 on the implementation of certain provisions of the Fertilisers and Fertilisation Act (Journal of Laws No. 119, item 765)
