Summary
Historically, the regulation of “insumos agrícolas” (“agricultural inputs”)—pesticides, fertilizers, and related substances—has been the responsibility of the Servicio Nacional de Sanidad Agropecuaria e Inocuidad Alimentaria (SENASAG), under the general statutory authority granted by Ley 2061 (16 March 2000) and Decreto Supremo 25729 (7 April 2000).
Within this framework, the older Reglamento para el Registro y Control de Plaguicidas, Fertilizantes y Sustancias Afines de Uso Agrícola (sometimes referred to as “Reglamento 055/2002”) served as the principal instrument for registering and controlling “insumos agrícolas” (“agricultural inputs”), including fertilizers and “sustancias afines” (“related substances”).
In October 2025, the national Senate approved Ley 017/2024-2025, which seeks to regulate “bioinsumos agroecológicos” (“agroecological bio-inputs”)—including their production, commercialization, and use—as an alternative to conventional agrochemicals. The law’s stated objectives include regulating the “elaboración, comercialización y uso de bioinsumos destinados a los sistemas productivos … agricultura, ganadería, acuicultura, forestería y bioregeneración ambiental” (“the production, commercialization, and use of bio-inputs intended for productive systems … agriculture, livestock, aquaculture, forestry, and environmental bioregeneration”).
As of late 2025, the law is described as a “política pública de bioinsumos agroecológicos” (“public policy on agroecological bio-inputs”) and represents a formal effort to create a dedicated regulatory framework for bio-inputs, which presumably would encompass biostimulants.
Implication: Once this law is enacted (and secondary regulations are adopted), biostimulants and similar organic or biological inputs will fall under their own regulatory regime—separate from, or at least differentiated from, conventional chemical fertilizers and pesticides.
However—and this point is important—the law appears to have been approved only by the Senate so far and has not yet completed the full enactment process. As a result, the practical regulatory landscape remains in flux, creating uncertainty for producers and importers of biostimulants.
